Answer: In Article 71 of the Law on Collection Procedure of Public Receivables, wages are listed among the incomes to be partially seized. It is stipulated that the amount to be seized of the incomes to be partially seized cannot be more than one third and less than one quarter of them, and no more than one tenth of the monthly incomes that do not exceed the minimum wage can be seized.
Your entire salary cannot be seized due to the Income Tax debt that you have not paid in due time. At most one third can be seized.
The ceiling amount of severance pay is 2.427 TL
Question: The salary of one of our employees is 5.000 TL gross and the working period is 1 year and 4 days. How much severance pay will we pay to this person? How should the accounting of the severance pay we will pay be? Will we take the severance pay ceiling into consideration?
Answer: In the practice until 30 June 2010, the ceiling amount of severance pay is TL 2.427.03. The severance pay that you will pay to your personnel for one year of work is 2.427.03 TL. You have to pay 26.97 TL within 4 days, totalling 2.454 TL. You will only deduct 6.6 per thousand Stamp Duty from this payment. Accounting of severance pay is no different from wage payments.
